Efektivitas Undang-Undang Terkait Jaminan Produk Halal Terhadap Makanan dan Minuman UMKM Tidak Bersertifikat Halal (Studi Kasus Di Kecamatan Cilodong Kota Depok)

Abstract

This study aims to explain how the effectiveness of the Law related to Halal Product Assurance for UMKM food and beverages is not halal-certified in Cilodong District, Depok City and the factors that cause most UMKM in Cilodong District, Depok City do not have halal certificates. This research uses a qualitative research type with a normative-empirical approach method which aims to discuss the application of the Law related to Halal product Assurance whether it has been effectively implemented or not by UMKM in Cilodong District, Depok City. The results of this study indicate that he effectiveness of laws related to halal product guarantees, namely Law Number 33 of 2014 concering guarantees for Halal Products and Law Number 6 of 2023 concering Job Creation for UMKM food and beverages in Cilodong District, Depok City, has not been fully effective even though there has been a program for making free halal certificates from the Depok City Government. Ass well as this study found several factors causing UMKM actors not to have halal certificates from the Depok City Government. As well as this study found everal factors causing UMKM actors not to have halal certificates, namely of their products, lack of knowledge and understanding of business actors regarding halal certificates, there is no willingness from business actors to apply for making halal certification, business actors assume that registering halal certification is difficult

Abstrak

Studi ini bertujuan untuk menjelaskan bagaimanakah efektivitas Undang-Undang terkait Jaminan Produk Halal terhadap makanan dan minuman UMKM tidak bersertifikat halal di Kecamatan Cilodong Kota Depok dan faktor-faktor penyebab sebagian besar UMKM di Kecamatan Cilodong Kota Depok tidak memiliki sertifikat halal. Penelitian ini menggunakan jenis penelitian kualitatif dengan metode pendekatan normatif-empiris yang bertujuan untuk membahas mengenai penerapan Undang-Undang terkaitJaminan Produk Halal apakah sudah  efektif dilaksanakan atau tidak oleh UMKM di Kecamatan Cilodong Kota Depok. Hasil penelitian ini menunjukan bahwa efektivitas undang-undang terkait jaminan produk halal yaitu Undang-Undang Nomor 33 Tahun 2014 tentang Jaminan Produk Halal dan Undang-Undang Nomor 6 Tahun 2023 tentang Cipta Kerja terhadap makanan dan minuman UMKM di Kecamatan Cilodong Kota Depok belum sepenuhnya efektif meskipun telah ada program pembuatan sertifikat halal gratis dari Pemerintah Kota Depok. Serta Penelitian ini menemukan beberapa faktor-faktor penyebab para pelaku UMKM belum memiliki sertifikat halal yaitu keyakinan pelaku usaha terhadap kehalalan produknya, kurangnya pengetahuan dan pemahaman pelaku usaha terhadap sertifikasi halal, tidak ada kemauan dari pelaku usaha untuk mengajukan pembuatan sertifikasi halal, para pelaku usaha beranggapan bahwa mendaftarkan sertifikasi halal itu sulit
